After Maduro declared President January, 10th for winning ilegal elections, there is an absent of power. Therefore, the Presidency of Venezuela became deserted.

Mr Guaido didn't declare himself as President, he swore as interim President due to a Constitutional mandate as Maduro's term is over and election was illegal. It's all very clear in the Venezuelan's Constituion. He is only there to call for free and transparent elections in a term of 30 days.
